Pasado, presente y futuro de la hipoteca : ¿una institución en crisis?

Este trabajo de investigación tiene por objeto realizar un análisis de la hipoteca.
Se plantea esta investigación desde el interrogante: ¿una figura en crisis? La realización
de este trabajo parte del estudio del Derecho Romano. En el Derecho Romano
encontramos el origen de esta figura y sus principales problemas. Desde esta
perspectiva histórica del Derecho, analizamos el estudio de la hipoteca en nuestra
actualidad. Procurando establecer los problemas que se dan en esta institución.
Acudimos a la realidad de Roma para ver posibles soluciones a los problemas que se
dan en la actualidad. Además, se aportan perspectivas de futuro para la hipoteca. Por
último, se concluirá resolviendo la pregunta de la que se parte.

This research is to conduct an analysis of the mortgage. This research arises from
the question: is a figure in crisis? The realization of this work in the study of Roman
law. In Roman law we find the origin of this figure and its main problems. From this
historical perspective of the law, the study analyzed our mortgage today. Seeking to
establish the problems that exist in this institution. We come to the reality of Rome for
possible solutions to the problems that exist today. Moreover, future prospects for the
mortgage provide. Finally, we conclude by resolving the former question.
