Pandemia, ¿cabe hablar de frustración del contrato o imposibilidad de realizar la prestación del seguro? Quid con el riesgo?

Cómo impacta la pandemia en un seguro y el rol y funciones que éste juega y cumple se están convirtiendo en una cuestión económica y jurídica clave en esta crisis primero sanitaria, luego económica. El plantemiento que queremos realizar en este artículo es otro, a saber, conocer cómo puede incidir esta cuestión en el sinalagma, en el riesgo contractual primero, y luego en el riesgo asegurado, la prima pero sobre todo, en ámbitos más abstractos y antecedentes, el de perimetrar el alcance de la imposibilidad de la prestación, la no existencia del riesgo asegurado y la excesiva onerosidad sobrevenida. Interrogantes que debemos resolver y que reorientarán no solo la actuación del seguro ante esta pandemia sino, quizá, reconfigurar al hilo de la misma el contrato en sí.

How the pandemic impacts on insurance and the role and functions it plays and fulfils are becoming a key economic and legal issue in this crisis - first health, then economic. The approach that we want to take in this article is different, namely, to know how this question can affect the synalagma, the contractual risk first, and then the insured risk, the premium, but above all, in more abstract and background areas, that of permeating the scope of the impossibility of providing the service, the non-existence of the insured risk and the excessive cost involved. These are questions that we must resolve and that will not only redirect the actions of the insurance company in the face of this pandemic but also, perhaps, reconfigure the contract itself.
