En este trabajo de fin de grado se analiza la Directiva 2019/790 sobre los derechos de autor y derechos afines en el mercado único digital. Esta directiva que venía siendo discutida desde 2016, por fin vio la luz y trajo consigo muchas novedades que han provocado, en algunos sectores, críticas negativas, como también elogios. Supone un gran avance en algunos aspectos que venían quedando obsoletos, en la normativa europea, al no adaptarse a la era digital, impidiendo la instauración del mercado único digital y restando competitividad a la Unión Europea.
El trabajo se divide en dos partes. Por un lado, se estudiarán las medidas introducidas por la Directiva para asegurar el cumplimiento de los derechos de autor que hasta ahora no estaban siendo eficientes en los Estados Miembros de la Unión Europea, perjudicando a titulares de derechos de autor y derechos afines. Por otro lado, se detallará las medidas introducidas por dicha Directiva con la finalidad de que los usuarios puedan tener una mayor facilidad en el acceso de las obras, a través de excepciones o limitaciones.
En los dos apartados, se explicará cómo afectará las medidas introducidas por la Directiva en la legislación española y su repercusión a nivel europeo en el futuro del cambio normativo.
This end-of-degree project analyse the Directive 2019/790 of 17 april 2019 on copyright and related rights in the Digital Single Market. This Directive which was been negotiated since 2016, finally was approved with some innovations in the intellectual property fields. Some groups affected consider this rule negative, in some aspects.Other groups eulogize the adaptation to the digital era.
The European rules on copyright were becoming obsoletes for the non-adaptation to the digital era, that was an obstacle to the establishment of the Digital Single Market, reducing the European Union's capacity to compete.
This work is divided in two parts. The first part of the work explore the measures introduced by the Directive to warrant the enforcement of copyright that until now had not been efficient in the European Member States regulation, this inefficiency caused damages to copyright holders. The second part analyse the measures introduced in the Directive with the purpose to benefit the persons with no economic objectives and facilitate the access to the works protected by the copyright with the exceptions and limitations.
In the first and the second part, the study of the measures introduced by the Directive go with the comparison of the Spanish's regulation and the potential impact on the Member States rules.
This work find to conclude if the Directive can conclude the objective of the instauration on the Digital Single Market.
