Las servidumbres prediales en el derecho romano y en la actualidad

Las cuestiones discutidas en el siguiente trabajo son las servidumbres prediales desde el
Derecho romano hasta la actualidad, estudiando de cerca aspectos como las
características, la creación, los tipos, la defensa y la extinción de las servidumbres
prediales. Nos centraremos sobre todo en las conclusiones en la herencia jurídica que
nos ha proporcionado el Derecho romano en general y más manifiestamente en este
tema. Por otro lado, lo largo del trabajo veremos resoluciones jurisprudenciales romanas
extraídas del Digesto, en las que observamos que posteriormente se adoptan como
normativa en nuestro Código Civil.

The matters discussed in the following assignment are real servitudes, since Rome to
the present days. We will be studying aspects such as the servitudes distinctive features,
the different types of servitudes, the defence and the extinction of real servitudes. We
will specially take attention to the substantial legal heritage that Roman Law has left us
behind, in all aspects of Civil Law, but specially in this one. On the other hand, during
the development of the essay we will be studying resolutions from The Digest, in the
Corpus Iuris Civilis, and seeing how many of them have been later on applied to legal
regulation of servitudes in our Civil Code.
