Las medidas de aseguramiento de prueba en Propiedad Industrial e Intelectual : encuadramiento y distinción con figuras afines

En el presente trabajo hemos tratado de reflejar por un lado la importancia
de los instrumentos propios de las actuaciones preparatorias en el ámbito del Derecho
de Propiedad Industrial e Intelectual, destacando especialmente la figura de las
medidas de aseguramiento de prueba y su distinción con otros elementos asemejados.
Y por otro, su evolución durante los últimos años, subrayando la importancia de la
Directiva 2004/48 y su transposición a nuestro ordenamiento con la Ley 19/2006.
También hemos aprovechado para denunciar una regulación todavía insuficiente para
garantizar los Derechos de Propiedad Industrial e Intelectual de los afectados, ante las
cada vez más comunes infracciones

In this work we’ve tried to show the importance of the different
instruments included in the preliminary proceedings, in the context of Industrial and
Intellectual Property Law, spotlighting the evidences assurance measures and its main
differences with similar instruments. On the other hand, we’ve showed its evolution
within the last years, focusing on the Directive 2004/48 and its transposition to our
system with the Ley 19/2006. We’ve also wanted to condemn the lack of a Strong
regulation, which guarantees the Industrial and Intellectual Property Rights, versus a
more and more infractions situation.
