La transmisión mortis causa de los bienes digitales

Es innegable que las nuevas tecnologías están presentes en el día a día de toda persona en nuestra sociedad, ya sea únicamente para su uso en la esfera personal o en la profesional. Dicho esto, también es innegable admitir que estos bienes digitales traen consigo riesgos y problemas. Es por ello por lo que la principal función de esta investigación es el análisis de los bienes digitales, en concreto, que ocurre con ellos una vez que el titular de estos bienes digitales fallece. Al encontrarnos en una sociedad digitalizada han surgido nuevos escenarios con respecto a la sucesión mortis causa que antes no existían y que, por ello, no están regulados en nuestro ordenamiento jurídico. En esta investigación analizaremos aquellas materias que el legislador sí ha regulado e intentaremos dar respuesta a aquellas cuestiones que, a día de hoy resultan confusas o poco prácticas con la regulación vigente. Analizaremos los bienes digitales, seguiremos las normas tradicionales del Derecho Sucesorio e investigaremos si esta nueva legislación atenta contra la intimidad y el honor del fallecido. A su vez, compararemos la legislación española con otras legislaciones como la catalana, la francesa y la estadounidense, en la que haremos especial hincapié ya que, sin duda, es la más avanzada en este ámbito.

It is a reality that technology is present in everybody’s life in today’s society, whether they apply this technology in a private matter, or in a professional matter. Having said this, it is also a reality that technology brings with it troubles and risks. The main purpose of this investigation is to analyze the digital assets, in particular, what happens to those digital assets once their owner dies. As we find ourselves in a digitalized society, new scenarios have arisen regarding the inheritance matter that did not exist before and therefore are not regulated in our legal system. In this investigation, we will analyze those matters that the legislator has regulated, and we will try to answer those questions that are still confusing or not practical with the current law. We will analyze what the digital assets are, we will follow the traditional Succession law and we will investigate if this new legislation violates the right of privacy and honor of the deceased. At the same time, we will compare the Spanish legislation with other legislations such as Catalan, French, and US legislation paying special attention to the last one, which is undoubtedly the most advanced in this area.
