La prohibición de la tortura y los tratos inhumanos y degradantes en el S. XXI

Este Trabajo Fin de Grado trata de la prohibición de la tortura y de los tratos inhumanos, y trata de explicar su persistencia hoy en día. En efecto, la tortura es el Derecho Humano más protegido en las diferentes áreas del Derecho Internacional, pero sigue existiendo en todos las partes del mundo, a veces de manera generalizada. Este trabajo se enfoca en explicar como se define la tortura y diferenciarla de los tratos inhumanos y degradantes, analizar cómo se prohíbe en el Derecho Internacional vigente y establecer los medios de tortura utilizados hoy en día. Para poder encontrar causas a la existencia de la tortura, es importante analizar en qué parte del mundo se usa más, estableciendo un resumen sucinto de la situación actual del uso de la tortura en el mundo. De allí, se pueden destacar causas que podrían explicar para qué se tortura, como la justificación militar que consiste en torturar para obtener confesiones. Se alude también a razones culturales, o razones vinculadas al contexto político: en periodo de guerra civil, se nota un aumento del uso de la tortura, justificado para vencer al enemigo. Por fin, otro tema fundamental al hablar de la tortura es el contexto de impunidad en el que se desarrolla, que favorece su uso porque los perpetradores saben que no serán enjuiciados. La tortura es un tema muy controvertido hoy en día, y una prohibición casi universal no fue suficiente para abolirla.

This thesis deals with the prohibition of torture and inhuman treatment, and tries to explain its persistence today. Indeed, torture is the most protected Human Right in the different areas of International Law, but it still exists in all parts of the world, sometimes in a generalized way. This paper focuses on explaining how torture is defined and differentiating it from inhuman and degrading treatment, analysing how it is prohibited in current international law and establishing the means of torture used today. In order to explain the causes of the existence of torture, it is important to analyze where it is most used, making an assessment of the current situation of the use of torture in the world. From there, it is posible to highlight causes that could explain why torture is used, such as the military justification that consists in torturing to obtain confessions. Cultural reasons, or reasons linked to the political context, are also mentioned: in a period of civil war, there is an increase in the use of torture, justified in order to defeat the enemy. Finally, another fundamental issue when talking about torture is the context of impunity in which it takes place, which favours its use because the perpetrators know they will not be prosecuted. Torture is a very controversial issue today, and an almost universal prohibition was not enough to abolish it.
