El Tribunal de Justicia de la Unión Europea aborda la cuestión de si la
legislación húngara relativa a la autoridad de control en materia de tratamiento de
datos personales permite a esta autoridad ser independiente en el cumplimiento de sus
funciones, teniendo también en cuenta que Hungría finalizó de forma anticipada el
mandato de la anterior autoridad sobre la base de un cambio en el modelo institucional
elegido para cumplir con las obligaciones impuestas por la Directiva 95/46/CE.
The European Court of Justice addresses the question of whether the
Hungarian legislation concerning the supervisory authority on the processing of
personal data allows this authority to be independent in the performance of its tasks,
also taking into account that Hungary brought prematurely to an end the term served by
the previous authority on the base of the change of the institutional model chosen for
fulfilling its obligations under Directive 95/46/EC.
