La obligación legal de prestar alimentos a los hijos mayores de edad

Este trabajo trata sobre el trato que reciben los hijos mayores de edad con respecto a la obligación de prestar alimentos. Centrándose para ello en los requisitos que exige la ley, más concretamente, los artículos 142 y 93 del Código Civil, según los cuales podrán ser alimentistas. Por lo que tendrán derecho a obtener lo que sea necesario para subsistir, incluyendo la educación, siempre y cuando no haya terminado su periodo formativo por causas imputables a ellos mismos; o que carezcan de ingresos propios y convivan en el hogar familiar en casos de pleitos matrimoniales. Sin embargo, hay que tener en cuenta que esta obligación no durará eternamente, ya que ese no es su fin, por lo que se prevén situaciones de modificación de la pensión cuando se alteren sustancialmente las circunstancias tenidas en cuenta a la hora de fijarla, y la extinción de ésta.

This project deals with the treatment of older children regarding the obligation of providing the alimony. Focusing on the requirements commanded by law, more specifically, Articles 142 and 93 of the Civil Code, according to which they can be maintenance creditors. Therefore, they will have the right to obtain what is necessary to survive, including education, as long as they have not completed their formative period due to causes attributable to themselves; or if they lack their own income and live in the family home in cases of marital litigation. It should be borne in mind, however, that this obligation will not last forever, since that is not the purpose, and situations of modification of the pension are foreseen when the circumstances taken into account are substantially altered when fixing it, and the extinction of this.
