El presente trabajo analiza la evolución del sistema de DIPr.
relativo al contrato de seguro en el ámbito europeo. Centra su estudio en los
contratos de seguro sobre grandes riesgos y los de riesgos masa.
The following paper analyses the evolution of the conflict of
laws regime related to insurance contract law in the EEA. The study focuses on
insurance contracts covering large risk and mass risks. First, it studies the Rome
Convention regime and the numerous Community Directives, with its relative
Spanish transposing law (art. 107 LCS). Comments to the outcome of the
system, criticism to the complexity, lack of transparency and inconsistency result
on the need to improve the system. Rome I Regulation comes into force as the
sole Community conflict of laws system with direct effect over all EU member
states. This regime is also analysed.
