La justicia contemporánea: de Rawls a Ricoeur

Partiendo de la propuesta de John Rawls en su obra Teoría sobre la justicia, realizaremos un repaso sobre las teorías contractualistas más importantes para reflexionar sobre la naturaleza del hombre y, en consecuencia, las exigencias a la hora de construir un sistema político. Estudiaremos distintos escenarios de estado de naturaleza y reflexionaremos sobre el Derecho natural en estos distintos escenarios. En último término, estudiaremos posibilidades políticas ante una situación de Derecho natural mutable, lo cual nos permitirá revisar la teoría de Rawls y reconducir nuestra atención hacia la importancia de la Hermenéutica y la reformulación de teorías iuspositivistas y iusnaturalistas que hasta ahora habían regido el estudio de la teoría política.

Starting from the study of John Rawl’s “Theory of justice” we will revise the main contractualist theories and reflect on man’s nature and, consequently, about the priorities when elaborating a political system. We will study different scenarios of “state of nature” and examine natural Law in all of them. Ultimately, we will study the different political options when confronting a situation of mutable natural law. This will allow us to inspect Rawl’s theory and focus on the importance of hermeneutics and the reformulation of the iuspositivist and iusnaturalist theories that, up until now, have dominated political theory.
