LA GARANTÍA DE LOS DERECHOS FUNDAMENTALES EN LAS NUEVAS TECNOLOGÍAS

Este estudio tiene por objeto observar el estado actual y futuro de la protección de datos de carácter personal en relación con las nuevas tecnologías, con el fin de analizar los avances llevados a cabo en dicha materia, tanto en el plano legislativo, como en el institucional y el jurisprudencial.
Para su elaboración se ha examinado el estado actual de la tecnología para tomar como referencia aquellos campos de la misma que más implicaciones tienen en el ámbito de los derechos fundamentales y en especial el derecho fundamental a la protección de datos personales. Con posterioridad se examina el estado actual de la legislación pertinente, para dar paso a los avances realizados, haciéndose especial hincapié en el análisis del Reglamento (UE) 679/2016. De este modo, tomando como referencia la actual tendencia en la evolución de la normativa atinente a la protección de datos, se pretende vislumbrar alguna que otra pauta que sirva para mejores avances en la materia. Desde esta perspectiva, como se demostrará, se advierte, tanto la necesidad de una aplicación más intensa de la Privacidad por Diseño, como la adopción de una actitud más proactiva por parte del legislador en lo referente al ámbito de la protección de datos de carácter personal.

The aim of this study is to take a look on the current and future state of the protection of personal data regarding new technologies, in order to analyze the progress made in this matter within the jurisprudential, legislative and institutional level.

For its elaboration, the current state of technology has been examined to take as a reference those fields that have more implications in the area of fundamental rights and specially, regarding the fundamental right to the protection of personal data. Subsequently, the current status of relevant legislation is reviewed in terms of the progress acomplished, with particular emphasis on the analysis of the GDPR. Thus taking as a reference the actual trends in the evolution of the regulations concerning data protection, it is intended to glimpse any patern that could serve for better progress in this area. From this perspective, as will be demonstrated, the need for more intense application of Privacy by Design, as well as the adoption of a much more proactive attitude from the legislative power are noticed.
