La carta española de derechos digitales. Análisis crítico y comparado.

Este trabajo de investigación y análisis tiene como finalidad el estudio de la carta de derechos digitales que fue presentada por el presidente del Gobierno el día 14 de julio de 2021 y que formaba parte de la Agenda España Digital 2025. Nos centraremos en su análisis y significado y las consecuencias que tiene y que puede tener. Compararemos la Carta con la legislación de la Unión Europea y el exterior y veremos cómo están considerados en diferentes ordenamientos estos derechos. Por último, realizaremos una crítica de esta y ofreceremos nuestras conclusiones.
Para realizar esta síntesis, hemos tenido que analizar la carta minuciosamente y hemos tenido que realizar un análisis de la situación en la que se encontraba nuestro ordenamiento jurídico respecto al entorno digital y su situación respecto del desarrollo digital y como se adaptara al futuro. Para comprender la situación actual hemos tenido que estudiar cómo afronta la Unión Europea esta situación y donde se encuentra. La tecnología avanza muy rápido y los riesgos que esta conlleva también es fundamental prepararnos jurídicamente para el futuro.

The purpose of this research and analysis work is to study “La carta de derechos digitales”, that was presented by the President of the Government on July 14, 2021 and that was part of the Digital Spain Agenda 2025. We will focus on its analysis and meaning and the consequences it has and may have. We will compare the document with the European Union legislation and other countries abroad and we will see how these rights are considered in different legal systems. Finally, we will make a critique of the published document and offer our conclusions.
In order to accomplish this synthesis, we had to analyze “La carta” in detail and we had to analyze the situation of our legal system with respect to the digital environment and its situation with respect to digital development and how it will adapt to the future. To understand the current situation, we have had to study how the European Union is facing this situation and where its standing. Technology is developing very fast and so are the risks that it entails, so it has become essential to prepare ourselves and our legislation for the future.
