Iglesia sui iuris. Un concepto canónico novedoso

El concepto canónico «Iglesia sui iuris», cuya plasmación positiva se produjo con la promulgación del Código de Cánones de las Iglesias Orientales (CCEO), ha venido a reflejar, en lenguaje canonistico, la tradición histórica y la enseñanza conciliar acerca del peculiar estatuto eclesiológico de las Iglesias orientales, dentro de la comunión católica. En el artículo se aborda el proceso que ha llevado a la plasmación positiva de este concepto, especialmente en relación al concepto «Iglesia particular», así como las notas distintivas del concepto «Iglesia sui iuris»: «agrupación orgánica de Iglesias particulares bajo la guía de un jerarca, en el seno de una tradición ritual oriental, a la que la Iglesia ha reconocido, expresa o tácitamente, este peculiar estatuto de autonomía» (sui iuris). El artículo aborda también la relación entre el concepto «Iglesia sui iuris» y «rito», la realidad actual de las Iglesias sui iuris, y plantea algunas cuestiones abiertas como la posible aplicación del concepto a otras realidades eclesiales o la pregunta acerca de si la Iglesia latina es una Iglesia sui iuris más.

The canonical concept «sui iuris Church», whose positive implementation was brought about with the promulgation of The Code of Canons of the EasternChurches (CCEO), has come to reflect, in canonical language, the historical tradition and conciliar teaching of the peculiar ecclesiological statute of the Eastern Churches within the Catholic communion. This article treats the process that led to the positive implementation of this concept, especially in relation to the concept «particular Church», as well as the hallmarks of the concept «sui iuris Church»: «the organized association of particular Churches under the guidance of a hierarch, within an Eastern ritual tradition, to whom the Church has recognized, explicitly or implicitly, this peculiar statute of autonomy» (sui iuris). This article also addresses the relationship between the concept «sui iuris» Church and «rite», the current reality of the sui iurìs Churches, and raises some open questions, such as the possible application of the concept to other ecclesial realities, or the question concerning whether the Latin Church is another sui iuris Church.
