“Estudio comparativo entre los sistemas de asilo político irlandés y español: problemáticas, contradicciones y propuestas indispensables de mejora"

Este trabajo de fin de grado investiga los sistemas de asilo de Irlanda y España, comparando tanto sus bases legislativas como sus practicas respectivas. Primeramente, he tratado de explicar la legislación en ambos países, cómo Irlanda mejoró su legislación en 2015 y las diferentes ayudas monetarias que ofrecen ambos gobiernos a los refugiados. Los dos gobiernos comparten un marco legislativo común, al tener que seguir muchas de las leyes de la Unión Europea, pero hay características propias que los hacen muy diferentes. En la siguiente parte, investigo la cantidad distinta de solicitudes en ambos sistemas, detallando los diversos orígenes de los solicitantes y los problemas asociados con tales movimientos. Esta parte incluye el famoso acuerdo de 2015, y como no ha funcionado, y veremos cómo el sistema español está colapsado con tiempos de espera muy largos y tasas positivas de decisión sobre el titulo de refugiado muy por debajo de la media europea. A continuación, explico las dificultades que existen para integrarse como refugiado en los dos países, con enfoque principal en derechos para trabajar, casos de salud mental, servicios de apoyo de los estados y la actitud de la sociedad frente a los refugiados en el país. Termino el trabajo con unas conclusiones sobre la situación, y también unas recomendaciones sobre cómo se podía mejorarla.

In this thesis I investigate the political asylum systems of Spain and Ireland, with regard to both their legal bases and their current practices. First, I explore the legislation of both countries, explaining the changes in the Irish system after 2015 and the financial supports that both governments offer international protection applicants. The two governments share a common legislative base, as they have to follow many laws of the European Union, but each has their own characteristics which differentiates them.
I then explore the contrasting quantity of applicants in the systems, while detailing the diverse origins of said applicants and the problems associated with these movements. This part involves studying the 2015 agreement within the EU, and its subsequent failure, and it also shows how the Spanish system has fallen apart with lengthy waiting times and a rate of positive decisions far below the European average. I then detail the problems refugees have integrating into both countries, with a specific focus on labour rights, mental health issues, government support services and the social attitude towards refugees in that country. I end the thesis with conclusions about the situation, and recommendations for how it could be improved.
