El derecho de propiedad. Su evolución en Derecho romano

El derecho de propiedad que se configura a lo largo de la historia de Roma se traslada hasta nuestros días como un elemento fundamental dentro del sistema económico imperante. En el presente trabajo se estudia y revisa la literatura sobre el origen y evolución del concepto de propiedad en Roma, los tipos de propiedad que se dan a lo largo de la historia en el marco del Derecho Romano, las limitaciones que afectan a esta, así como la evolución de las mismas a lo largo de las distintas épocas de Roma, los modos de adquirir la propiedad, tanto originarios como derivativos, las diferentes acciones de defensa de la propiedad y el concepto de condominio o copropiedad. A lo largo del estudio se relacionan los preceptos romanos con su impacto en la legislación española vigente con el objetivo de resaltar la importancia que sigue teniendo hoy en día la experiencia jurídica romana en nuestro sistema jurídico. Por último, se analiza cuál es la importancia que tiene el concepto de propiedad en nuestra sociedad, así como ejemplos históricos del impacto que ha tenido la restricción del derecho de propiedad y las implicaciones económicas que se pueden derivar de la existencia o no de esta.

The property rights, which have been configured throughout the history of Rome, have been transferred to the present day as a fundamental element within the prevailing economic system. This paper studies and reviews the literature on the origin and evolution of the concept of property in Rome, the types of property that occur throughout history within the framework of Roman Law, the limitations that affect it, as well as their evolution throughout the different periods of Rome, the ways of acquiring property, both original and derivative, the different actions to defend property and the concept of condominium or co-ownership. Throughout the study, the Roman precepts are related to their impact on the current Spanish legislation with the aim of highlighting the importance that the Roman legal experience still has today in our legal system. Finally, the importance of the concept of property in our society is analysed, as well as historical examples of the impact that the restriction of property rights has had and the economic implications that can be derived from the existence or not of this.
