Clases de distribuidores de seguro

Sin duda una de las grandes novedades de la nueva normativa de distribución, fruto de la Directiva, es la ampliación legal de la dimensión subjetiva de la condición de distribuidor de seguros. Por vez primera una norma regulará la actividad de distribución de seguros y reaseguros realizada por una entidad aseguradora. Un reconocimiento explícito, amén de manifiesta consagración legal que implica, de suyo, una ampliación en la actividad de distribución de seguros amén de la inclusión también de los mediadores de seguros complementarios. Mas no solo se amplía el abanico legal de quiénes intermedian en el seguro sino también que se define, o trata de ofrecerse un concepto, como acaece con éstos últimos. Cuestión distinta es, si una vez más, el legislador a la hora de conceptualizar lo hace por las características y funciones que tendrán estos sujetos por la concreta actividad que realizan, renunciando en puridad a ofrecernos una auténtica definición.

Undoubtedly one of the major novelties of the new distribution regulations, the result of the Directive, is the legal extension of the subjective dimension of the status of insurance distributor. Different question is, if once again, the legislator at the time of conceptualizing it does it by the characteristics and functions that these subjects will have for the concrete activity that they carry out, renouncing in purity to offer us an authentic definition.
