Análisis de la hipoteca flotante

En el presente trabajo se estudia la llamada hipoteca flotante que regula el art. 153 bis LH. En concreto, su carácter de indistinta y global, si responde al concepto de flotabilidad y sus diferencias con otras figuras hipotecarias, tanto del Derecho Español como del Derecho Comparado.
Asimismo, del análisis de la jurisprudencia registral y del art. 153 bis LH se expone su configuración y qué novedad supone frente a las hipotecas que garantizan una pluralidad de obligaciones, obligaciones futuras o cuentas corrientes o de crédito.

This paper provides a study on the so-called floating mortgage regulated by art. 153 bis LH. In particular, its character of indistinct and global guarantee, if it responds to the concept of floating mortgage and its differences with other types of mortgages, either from Spanish Law or Comparative Law.
Moreover, from the analysis of the registry jurisprudence and the art. 153 bis LH this project provides an explanation on the configuration of this mortgage and the novelty it supposes against the mortgages in guarantee of a plurality of obligations, future obligations or checking accounts.
