Vulnerabilidad, compasión y ternura

En este artículo nos aproximamos a la cuestión del sufrimiento poniendo el foco
de atención en nuestra condición de seres vulnerables y en el reconocimiento de
la vulnerabilidad propia y ajena. Respecto al sufrimiento, es contemplada como
causa y posibilidad, pero también, como un camino necesario cuando tratamos
de acompañar el sufrimiento del «otro» (com-pasión). Una vulnerabilidad que encuentra su paradigma último en un Dios que se hace vulnerable y que, a través de
la compasión y la ternura, nos enseña, no solo a acompañar el sufrimiento, sino a
abrazarlo y transformarlo en una dinámica que nos humaniza.

The art of legislating: ex ante and ex post legislative evaluation. The development of normative technique, the art of legislating with quality, as an expression of so-called smart regulation, involves promoting the improvement of norms not only from a formal perspective but also a material one. Norm evaluation (or legislative policy) and its consequences (either ex ante or ex post) are becoming increasingly recognized and linked to quality in the field of legal activity. There is evidently a direct relationship between ex ante and ex post legislative evaluation: the former sets the terms for evaluation in the latter (such as compliance with the forecasts contained in the regulatory impact analysis memorandum), and the latter allows for the improvement of prospective impact assessment systems. There are thus several elements that allow us to affirm that both ex ante and ex post evaluation of norms are already an unavoidable necessity in our legal system, not only for reasons of quality, effectiveness, and normative efficiency, but also as instruments that can help counteract the high degree of social disaffection shown by our contemporary democracies.
