Función de la garantía real

La idea central de este ensayo es contrastar y también constatar que, lejos de que una garantía real siga cumpliendo sus funciones, la realidad es que las clásicas figuras han perdido fuerza, tal vez por la inercia y los parámetros configuradores de las mismas hasta el presente, llevándolas a un punto donde la estructura resiste, pero es onerosa, gravosa, poco funcional, documentalmente farragosa y no reporta tantos beneficios ni para garante ni para acreditante. Al contrario, vivimos un acentuado proceso de redefinición de la garantía crediticia y de cuestionamiento constante y permanente sobre la utilidad cierta y real de las mismas. Esta obra plantea la tensión entre los nuevos esquemas credituales y la persistencia de un sistema que da síntomas de ineficiencia y agotamiento. Esa es la cuestión.

The central idea of this essay is to contrast and also to confirm that, far from a real guarantee continuing to fulfil its functions, the reality is that the classic figures have lost strength, perhaps due to the inertia and the parameters that have shaped them up to the present, leading them to a point where the structure resists, but is onerous, burdensome, not very functional, documentarily cumbersome and does not bring many benefits either for the guarantor or the creditor. On the contrary, we are experiencing a marked process of redefinition of the credit guarantee and a constant and permanent questioning of its true and real usefulness. This work raises the tension between the new credit schemes and the persistence of a system that is showing signs of inefficiency and exhaustion. That is the question.
