Técnicas de protección patrimonial de la persona con discapacidad

El presente trabajo se centra en las técnicas de protección patrimonial de la persona con discapacidad. La protección jurídica y patrimonial de la persona con discapacidad reviste especial importancia si analizamos la realidad social de nuestro tiempo.
La ley 41/2003, de protección patrimonial de las personas con discapacidad, constituye la respuesta desde el ámbito del Derecho Privado a la situación jurídica y patrimonial del discapacitado. La citada ley regula una serie de técnicas de protección patrimonial del discapacitado, a saber, el patrimonio especialmente protegido, la autotutela, el apoderamiento preventivo y las sustituciones fideicomisarias.

The ley 41/2003, de protección patrimonial de las personas con discapacidad, regulates certain mechanisms of protection of the heritage of the disabled people, creating a specific type of heritage that satisfies the needs of the disabled people, the possibility to adopt the provisions regarding the person and the heritage of the disabled person or the amendments introduced by this law regarding legacies.
