Regulación de las invenciones relacionadas con Inteligencia Artificial en el campo de la Propiedad Intelectual

Los sistemas de inteligencia artificial han evolucionado a un ritmo vertiginoso durante los últimos años, y ya son capaces de funcionar con relativa autonomía y emular conductas humanas si se les prepara, como ocurre con la creación de obras plásticas y literarias, que funcionarán como eje vertebrador de este estudio.
Así, debido a que en estas creaciones artísticas la línea entre la aportación humana y la de la inteligencia artificial es cada vez más difusa, se originan importantes retos jurídicos como la potencial protección de dichas obras a través de la Ley de Propiedad Intelectual. Por ello, a lo largo del estudio se profundizará en los actos que llevan a cabo estos entes informáticos y su grado de creatividad, que será una cuestión esencial para dilucidar más adelante si cumplen los requisitos exigidos por la ley para ostentar derechos de autor sobre las creaciones.

Artificial intelligence systems have evolved at a dizzying rate in recent years, and are already capable of functioning with relative autonomy and emulating human behavior if prepared, as occurs with the creation of plastic and literary works, which will function as the vertebral axis of this study.
Thus, due to the fact that in these artistic creations the line between human contribution and artificial intelligence’s contribution is blurred, important legal challenges are arising such as the potential protection of these works through the Intellectual Property Law. Therefore, throughout the study, we will make a detailed analysis of the acts carried out by these computer-based beings and their degree of creativity, which will be an essential question in order to determine afterwards whether they meet the requirements demanded by the law to hold copyright on the creations.
