Los derechos de autor sobre las creaciones generadas por inteligencia artificial

La Inteligencia Artificial está cambiando nuestra forma de vida, haciendo posibles realidades que eran inimaginables hace pocos años. Conceptos como digitalización, Big Data o Inteligencia Artificial están conformando una nueva realidad social, que afecta a todos los sectores y ámbitos de la vida. En concreto, los últimos avances en estas nuevas tecnologías están cambiando los paradigmas existentes sobre creatividad y aprendizaje, consideradas hasta el momento como capacidades exclusivamente humanas. La inteligencia Artificial se ha demostrado ser capaz de imitar la mente humana y realizar creaciones artísticas, literarias y científicas.

Estas obras, creadas por sistemas inteligentes, plantean, a nivel jurídico un nuevo escenario en el ámbito de la propiedad intelectual y los derechos de autor. El proceso creativo ha cambiado, así como los actores que participan en el mismo. Ante esto el Derecho no puede mantenerse al margen de esta realidad y debe acompañar a la sociedad proporcionando seguridad jurídica a los actores involucrados en el proceso creativo.

El objetivo de este trabajo es el análisis de los derechos de autor en las creaciones generadas por Inteligencia Artificial. Para ello, se lleva a cabo un análisis exhaustivo de la situación actual tanto a nivel de Propiedad Intelectual y Derechos de Autor como de la Inteligencia Artificial, poniendo el foco sobre la creatividad y el aprendizaje. A continuación, se relacionan ambos conceptos A partir de lo anterior, se hace un análisis de los actores implicados y se finaliza planteando retos y propuestas que permitan al derecho adaptarse a la nueva realidad, protegiendo a los autores de las obras a la vez que se fomenta la innovación y la creatividad, dos de los objetivos que la normativa de propiedad intelectual persigue conseguir.

Artificial Intelligence is changing our way of life, making possible realities that a few years ago we would not have been able to imagine. Concepts such as digitalization, Big Data or Artificial Intelligence are shaping a new social reality, affecting all sectors and areas of life. Specifically, the latest advances in these new technologies are changing the existing paradigms on creativity and learning, considered until now as exclusively human capabilities. Artificial intelligence is capable of imitating the human mind and producing artistic, literary or scientific creations.

These works, created by intelligent systems, pose, at the legal level, a new scenario in the field of intellectual property and copyright. The creative process has changed, as have the actors involved in it. Law cannot remain on the sidelines of this reality and must accompany society by providing legal certainty to the actors involved in the creative process.

The aim of this paper is the analysis of copyright in the creations made by Artificial Intelligence. For this purpose, an exhaustive analysis is made of the current situation both at the level of Intellectual Property and Copyright and Artificial Intelligence, focusing on creativity and learning. Based on the above, an analysis of the actors involved is made and ends with challenges and proposals that allow the law to adapt to the new reality, protecting the authors of the works while promoting innovation and creativity, two of the objectives that intellectual property law seeks to achieve.
