La revisión legal de la incapacitación

El objeto principal de este trabajo es analizar las nociones de la discapacidad, incapacidad y capacidad modificada judicialmente (antigua incapacitación), de las personas, su evolución, basándonos en la reforma del Código Civil de 24 de octubre 1983, la Ley 41/2003 de 18 de noviembre de Protección Patrimonial de las Personas con Discapacidad y de modificación del Código Civil, la Convención de Nueva York de 13 de diciembre de 2006 de las personas con discapacidad, y el Anteproyecto de Ley por la que se reforma la legislación Civil y Procesal en materia de discapacidad, exponiendo las instituciones de protección y apoyo actuales de las personas discapacitadas.
Para ello, se profundiza en las nuevas concepciones referidas a esta discapacidad intelectual, partiendo de las dos nociones imprescindibles en el Derecho de la Persona: la capacidad jurídica y la capacidad de obrar.
Se analiza y vigente sistema de Derecho español al que se ha incorporado la Convención de los derechos de las Personas con Discapacidad.
Y, por último, se estudia el Anteproyecto de ley para la reforma del Código Civil, y el cómo se pretende adaptar la normativa española a la Convención (junto con el cambio de la incapacitación al sistema de apoyos, pasando por la capacidad modificada judicialmente, y explicando en qué consisten esos nuevos apoyos o medidas que se prevén en dicho Anteproyecto).

The main object of this final degree project is to analyse the concepts of the disability and the judicially modified competence (old disability) of people, their evolution, based on the Reform of the Civil Code of October 24, 1983, the Law 41/2003 of November 18 of Patrimonial Protection of People with disabilities and modification of the Civil Code, the New York Convention of December 13, 2006 of people with disabilities, and the Draft Law that reforms the Civil and Procedural legislation on disability, exposing the current institutions of protection and support of disabled people.
In order to do so, the new visions referring to this intellectual disability are deepened, starting from the two essential concepts in the Civil Law: the legal competence and the ability to act.
The Spanish Law system is analysed and in force, to which the Convention on the Rights of Persons with Disabilities has been incorporated.
And, finally, the Preliminary Draft Law for the reform of the Civil Code is being studied, as well as the way in which Spanish legislation is intended to adapt to the Convention (together with the change of former incapacitation to the support system, passing through the judicially modified competence, and explaining what these new supports or measures consist of that Preliminary Draft).
