La pandemia y el derecho de huelga: ¿ha afectado el coronavirus a este derecho fundamental?

En el presente trabajo abordaremos la cuestión de si el COVID-19 ha podido afectar o no al Derecho de Huelga y en qué medida, en caso de que la respuesta sea afirmativa. Para ello iremos analizando distintos factores que hayan podido ser determinantes para resolver esta cuestión, comenzando por los parcialmente inconstitucionales RDs 463 y 956/2020 y pasando por cuestiones como el esquirolaje tecnológico o el empuje que ha podido subir el recurso al teletrabajo gracias a la pandemia de COVID-19 que estamos sufriendo.
Junto con este análisis de estas cuestiones, iremos desglosando la jurisprudencia más relevante para ver sobre qué elementos ha de pivotar nuestra posible respuesta a esta cuestión. La jurisprudencia será un elemento muy relevante a la hora de articular cualquier respuesta que pretendamos dar a esta cuestión ya que, como iremos viendo, han sido nuestros tribunales los que siempre se han encargado de dar respuesta a las cuestiones más controvertidas relacionadas con este derecho (debido a la parálisis del poder legislativo en esta materia).

In this paper we will address the question of whether or not COVID-19 has affected the right to strike and to what extent, if the answer is affirmative. To do so, we will analyse different factors that may have been decisive in resolving this question, starting with the partially unconstitutional RDs 463 and 956/2020 and including issues such as technological scabbing or the boost given to the use of telework thanks to the pandemic of COVID-19 that we are suffering.
Along with this analysis of these issues, we will be breaking down the most relevant case law to see on which elements our possible response to this question should pivot. Case law will be a very relevant element when it comes to articulating any response we intend to give to this issue since, as we will see, it has always been our courts that have been responsible for responding to the most controversial issues related to this right (due to the paralysis of the legislative power in this area).
