La calificación jurídica de un ciberataque como ataque armado a la luz del ordenamiento jurídico internacional

Desde 2007, con los ataques sufridos por Estonia, determinados incidentes cibernéticos relevantes han sido objeto de atención desde el punto de vista de la seguridad internacional. Estos ciberataques han continuado, desde entonces, su crecimiento en sofisticación, regularidad y gravedad, pudiendo dar lugar a la afectación de Infraestructuras Críticas estatales, como en el caso del virus Stuxnet o, incluso, llegar a plantearse la posibilidad del desarrollo de la denominada ciberguerra. Ante esta situación, resulta relevante analizar si dichos ciberataques pueden ser calificados como ataques armados a la luz del Derecho Internacional, específicamente, a la luz del Ius ad bellum, y así constituir, por lo tanto, un elemento imprescindible para la activación del mecanismo de la legítima defensa.

Since 2007, due to the attacks suffered by Estonia, specific relevant cyberattacks have received attention from an international security perspective. These cyberattacks have increased since then, in terms of sophistication, regularity and gravity; allowing critical infrastructures of the state to be potentially affected, as it occurred with the Stuxnet virus case, or even as far as contemplating the possibility of the so-called “cyberwar”. Thus, it would be relevant to analyse whether these cyberattacks could be classified as armed attacks in the light of International Law, specifically, and in the light of lus ad bellum; to be able to, therefore, establish an essential factor regarding the activation of mechanisms for a legitimate defence.
