El papel de la autoridad judicial en la búsqueda de la sentencia justa

La búsqueda de justicia debe ser el fin último del Derecho y, en todo sistema legal, el juez es quien tomas las decisiones que aplicando la ley, en este sentido el objetivo del trabajo es determinar cuál es el rol que juega un juez o magistrado a nivel general
dentro de un ordenamiento jurídico y, si es la existencia de éste es condición necesaria
para la actividad de una figura de autoridad judicial. Determinaremos la importancia de
la condición humana, pues los jueces no dejan de ser individuos con sus características
personales propias y si éstas afectan para bien o para mal en la búsqueda de la justicia.
Por último, establecer el estado actual del ordenamiento español en este sentido, cuales
son las críticas que se vierten a nuestro sistema, si éstas están justificadas y si tenemos un
ordenamiento que pueda garantizar la consecución un proceso que finalice con una
decisión lo más aproximada posible a lo justo.
