El Derecho Migratorio Común en la Unión Europea. ¿Un Modelo para el Mercosur?

This research paper is dedicated to the analysis of legislation on immigration issues in the European Union and the Southern Common Market. Both organizations with supranational character were born with a clear objective, the economic cooperation of the member countries that benefited all of them and made their markets grow exponentially, uniting them and thus constituting a much more relevant international economic bloc. Part of the economic flow is the flow, the movement, of workers. Therefore, this is one of the first subjects to be regulated within these supranational cooperation organizations. However, the European Union has not stayed here, and in its integration process has begun to harmonize the legislation of its States that touches the migration management of those from third States. Thus, the objective of this paper is to try to elucidate, through analysis and comparison of the legislative evolution in migration legislative matters of both blocks (EU and the Southern Common Market), if the Southern Common Market migration legislation will evolve towards a harmonization similar to that experienced. in the EU.

El presente trabajo de investigación se dedica al análisis de la legislación sobre materia migratoria existente en la Unión Europea y el Mercosur. Ambas organizaciones con carácter supranacional nacieron con un objetivo claro, la cooperación económica de los países miembros que beneficiase a todos estos e hiciese crecer de forma exponencial sus mercados, uniéndolos y constituyendo así también un bloque económico mucho más relevante a nivel internacional. Parte del flujo económico es el flujo, el movimiento, de los trabajadores. Por lo tanto, es ésta una de las primeras materias a regular dentro de estas organizaciones supranacionales de cooperación. Sin embargo, la Unión Europea no se ha quedado aquí, y en su proceso de integración ha comenzado a armonizar la legislación de sus Estados que toca la gestión migratoria de aquellos provenientes de terceros Estados. Así, el objetivo de este trabajo es intentar dilucidar, mediante el análisis y comparación, si, de la evolución legislativa en materia migratoria de ambos bloques (UE y Mercosur), se traslucirá en una evolución de la legislación migratoria del Mercosur hacia una armonización similar a la vivida en la UE.
