El alcance y los parámetros de la responsabilidad patrimonial respecto a la actuación de la Administración del Estado Español por los actos que afectan a particulares en el exterior

Este trabajo pretenderá resolver cuestiones relativas a la Responsabilidad Patrimonial del Estado con los actos acontecidos fuera de sus fronteras. Es decir ¿asume igualmente su responsabilidad la Administración por sus acciones en territorio español que en territorio extranjero? ¿Existe alguna excepción en el modus operandi de la Administración de cara a lo que sucede fuera de las fronteras o responde siempre igual? ¿Hay elementos comunes? ¿Se debe aplicar siempre la teoría del nexo causal entre el daño producido por la Administración y su actuación para reclamar la responsabilidad patrimonial al Estado? ¿Cuáles son los requisitos para que se cumpla esta teoría? ¿Se cumple esta obligatoriedad de concurrencia de requisitos a la hora de dictar sentencias? ¿Si solicito protección internacional por ser una persona protegida y la Administración no me la concede o lo hace de forma negligente, le es imputable RPA?... Estas y muchas más preguntas son las que tratará de responder esta investigación.

Sin embargo, tras la lluvia de incógnitas mencionada en el párrafo superior, cabe aclarar que la “verdadera gran duda” que pretende resolver el presente trabajo es: ¿Existen unos parámetros, límites o líneas de actuación que marquen la forma de actuar de la Administración cuando se le atribuye Responsabilidad Patrimonial por actos que perjudican a nacionales españoles pero que tienen lugar en el extranjero?

Pues bien, para la resolución de esta gran incógnita, se abordará el objeto de la investigación empezando por la base del ordenamiento jurídico, es decir, la Constitución y las Leyes que conciernen este tema; para posteriormente proceder con la lectura y análisis de múltiples sentencias (aunque no han sido numerosas a lo largo de la historia, por ser una problemática muy específica) y tras todo ello, tratar de extraer elementos o características comunes de la actuación de la Administración en asuntos de RPA de actos que tengan lugar en el extranjero.

This work will try to solve issues related to the Patrimonial Responsibility of the State with the acts that occurred outside its borders. In other words, does the Administration assume its responsibility for its actions in Spanish territory as well as in foreign territory? Is there any exception in the modus operandi of the Administration in the face of what happens outside the borders or does it always respond the same? Are there common elements? Should the theory of the causal link between the damage produced by the Administration and its action always be applied to claim patrimonial responsibility from the State? What are the requirements for this theory to be fulfilled? Is this mandatory concurrence of requirements fulfilled when issuing sentences? If I request international protection for being a protected person and the Administration does not grant it to me or does it negligently, is RPA attributable to it?... These and many more questions are what this investigation will try to answer.

However, after the rain of unknowns mentioned in the upper paragraph, it should be clarified that the "true great doubt" that this work intends to resolve is: Are there parameters, limits or lines of action that mark the way of acting of the Administration? When is Patrimonial Responsibility attributed to him for acts that harm Spanish nationals but that take place abroad?

Well, for the resolution of this great unknown, the object of the investigation will be addressed starting with the basis of the legal system, that is, the Constitution and the Laws that concern this subject; to subsequently proceed with the reading and analysis of multiple sentences (although they have not been numerous throughout history, as it is a very specific problem) and after all this, try to extract common elements or characteristics of the Administration's action in RPA matters of events taking place abroad.
