Efectos jurídicos de la hipoteca tras el divorcio

En el presente trabajo de Fin de Grado se abordará el estudio de la hipoteca (en la vivienda familiar) tras el divorcio y en el seno de los regímenes matrimoniales de separación de bienes y gananciales. Se comenzará realizando un análisis sobre la institución de la vivienda familiar, así como de la hipoteca que puede constituirse sobre la misma. A continuación, se llevará a cabo un estudio sobre los distintos regímenes patrimoniales del matrimonio que existen en el sistema español; y en tercer lugar se profundizará en el núcleo fundamental del trabajo que se refiere a las previsiones legales y jurisprudenciales sobre el pago de las cuotas del préstamo hipotecario sobrevenida la crisis matrimonial, fuera cual fuere el régimen matrimonial establecido. Finalmente, se analizarán los efectos para el caso de fallecimiento de uno u ambos excónyuges, así como aquellos que se producirían con la compraventa de la vivienda hipotecada.

This Final Degree thesis will deal with the study of the mortgage (on the family home) after divorce and within the matrimonial regimes of separation of property and community property. It will begin with an analysis of the institution of the family home, as well as the mortgage that can be constituted on it. Next, a study will be carried out on the different matrimonial property regimes that exist in our Spanish system; and in third place we will focus on the fundamental nucleus of the work that refers to the legal and jurisprudential provisions on the payment of the installments of the mortgage loan upon the matrimonial crisis, regardless of the established matrimonial regime. Finally, the effects in the case of death of one or both ex-spouses will be analyzed, as well as those that would be produced with the purchase and sale of the mortgaged property.
